11. Miller establishes a lower standard of proof of obscenity by requiring only proof that material alleged to be obscene does not have significant artistic, scientific, or literary merit. An earlier standard simply required that the material possess some artisitc, scientific, or literary merit. Attempts to make Miller part of the definition of obscenity in state constitutions are also usually accompanied by attempts to substitute local standards for statewide ones, since individual cities and towns are often more conservative than the population of a state taken as a whole.
